14-year-old boy charged in Little Haiti shooting, killing father of 3 and leaving another man hospitalized

MIAMI — A teenage boy was arrested and is now facing murder-related charges in connection to a Little Haiti shooting that left a father of three dead and another father hospitalized two weeks ago, police said.

On Wednesday, the City of Miami Police announced that they had arrested the 14-year-old and charged him with one count of second-degree murder and another count of attempted second-degree murder as a juvenile. CBS News Miami is not naming the him or showing his face because he is a minor.

Just before 1 a.m. on Oct. 11, Miami Police officers were called out to a ShotSpotter alert near 131 NE 77th St., where they found two men who were shot numerous times.

One of those men, 45-year-old Robin Fernandez, died at the scene. The other, 31-year-old David Pichinte, was rushed to Jackson Memorial Hospital in critical condition. 

Pichinte initially was on life support and his wife Liz Ortiz told CBS News Miami that there was significant damage to one of his organs. She said she did not understand why someone opened fire against Pichinte, who is the father of a girl and two boys. 

Fernandez was shot six times.

Miami Police credited their detectives for their work.

They said surveillance tape showed the suspect leaving his home at 7741 NW Second Court and going to the crime scene outside an apartment building at 131 NE 77th St. and then going back home. It is a distance of four blocks and is roughly a 5-minute walk.

Surveillance video recorded part of the attack. You hear gunfire and see people running. Police and witnesses said the teenager showed up outside the building and started asking for a drink. Then they say he pulled out a gun, demanded money and started chasing the victims.

Witnesses said Pinchinte tried to wrestle the gun away from the attacker but fell and was shot two times.  

On Tuesday evening, Williams was apprehended at his home and taken to Miami Police's Central Station for questioning. Williams was then interviewed by police without legal representation after being read his rights, arrest documents stated. After the interview, he was arrested and charged with homicide.

He came before Circuit Court Judge Michelle Barakat at the Children's courthouse on Wednesday afternoon. She found probable cause for the charges and ordered him to stay away from the surviving victim. 

He is being held in a secured area in the Miami Dade Regional Juvenile Detention Center.  

The youngster agreed to do what the judge ordered. The teenager's aunt and uncle also appeared in court but said they did not want to say anything.

Police say he is also tied to another case involving a strong arm robbery.

Prosecutors said they would take 21 days to determine whether to charge him as an adult.
